What Families Ask After a Fatal Pickup Crash in Los Angeles County

California allows two years from the date of death to file a wrongful death claim under Code of Civil Procedure section 335.1. The state's minimum liability coverage is only $30,000 for one injured person and $60,000 for more than one, according to the DMV. A wrongful death claim can include funeral costs, lost financial support and the loss of a loved one's companionship.

Who can file a claim after a fatal crash?

Certain close family members. Code of Civil Procedure section 377.60 lists them, starting with a surviving spouse or domestic partner and children. When there are none, other heirs, and sometimes dependent parents, may qualify.

Can a passenger's family file a claim if the driver also died?

Possibly. A claim may reach the driver's insurance, and the truck's owner may share responsibility, depending on the facts.

What if another vehicle or a road condition played a part?

Others may share responsibility. Whether the damaged gate or bumper seen away from the scene is connected is unknown, so the truck and scene evidence should be preserved.

What should the family do first?

Ask Whittier police for the report and the investigator's contact, and ask that the truck not be released or salvaged. Send insurer calls to one person.

How long does the family have?

Two years from the date of death, which here means October 18, 2028. Starting early protects evidence that fades with time.
