Key Legal Points After a Vehicle Crashes Into a Business in Westminster, CA

California's DMV sets the minimum property damage liability coverage at $15,000, which may not cover a repaired storefront. Injuries add to the total.

  • First steps: Get medical care the same day, photograph the damage and the vehicle before cleanup, and ask the responding agency for the report number.
  • Who may be liable: The driver and, in some cases, the owner of the car. Responsibility depends on what investigators find caused the crash, which is not yet known.
  • If fault is shared: California follows pure comparative fault, so a person who is partly responsible can still recover a reduced share.
  • Insurance that may apply: The driver's liability policy, the business's property policy, and your own medical or uninsured motorist coverage. If the injured person was working, workers' compensation may also apply alongside a claim against the driver.
  • For the business: An owner or tenant should notify the property insurer, keep repair estimates and records of lost business income, and not discard damaged inventory until the insurer has seen it.
  • Injury deadline: Code of Civil Procedure section 335.1 puts the filing deadline at October 20, 2028.
  • Property damage deadline: Section 338 generally allows three years, until October 20, 2029.
