What Families Should Know After a Fatal Crash in Los Angeles County

Who might be responsible?

Until CHP releases more detail, it's not yet clear whether another driver, a vehicle defect, or a road hazard contributed to this crash. Liability can rest with another motorist, a vehicle owner, or in some cases a public entity responsible for maintaining the roadway.

What do investigators look at?

The CHP collision report, any available event data recorder information, witness accounts, and the physical evidence at Amar Road and Evanwood Avenue all factor into how fault gets determined.

What if the person who died shares some fault?

California follows a pure comparative fault rule. A family can still recover damages even if the person killed is found partially responsible, with the award reduced by that percentage. Fault is rarely clear this early, and it shouldn't be assumed either way.

Is there a deadline?

Wrongful death claims in California must generally be filed within two years of the date of death (CCP 377.60). Based on this incident, that deadline falls on July 2, 2028.
