Legal Rights of Shooting Victims in California

Being shot outside a private residence or gathering can give rise to serious legal questions beyond the scope of a criminal investigation. In California, shooting victims and their families may have civil legal options that are entirely separate from any law enforcement proceedings.

Depending on the facts that emerge, potential areas of civil liability may include:

  • Claims against the shooter for assault, battery, and all resulting damages
  • Premises liability claims if a property owner's failure to maintain safe conditions or address foreseeable risks contributed to the incident
  • Claims for medical expenses, lost wages, pain and suffering, and other damages arising from the injuries sustained

What Shooting Victims and Families Should Know

A criminal investigation can take considerable time, and a civil claim does not require a criminal conviction or arrest to move forward. Given the severity of a chest wound, long-term medical care, rehabilitation, and loss of income can result in substantial damages.

In California, civil rights claims are generally subject to a two-year statute of limitations from the date of the incident (California Code of Civil Procedure § 335.1). Early legal consultation can help preserve important evidence and protect your rights within that window.

If you or a loved one was injured in a shooting, consider taking these steps:

  • Seek and document all medical treatment, including emergency and follow-up care
  • Preserve any available evidence, photographs, or witness contact information connected to the incident
  • Avoid providing recorded statements to any insurance representative before consulting with an attorney
  • Speak with a LA civil rights lawyer to understand your options under California law
