A tree fell on a moving minivan on McBean Parkway in Santa Clarita. Learn who may be responsible and the six-month claim deadline.

Santa Clarita, CA (October 16, 2026) - A tree uprooted and fell onto a moving minivan on McBean Parkway near Magic Mountain Parkway in Santa Clarita on October 16, while strong Santa Ana winds were blowing, according to the driver's account.
The driver said the tree landed on top of her minivan, cracked the windshield, and sent shattered glass onto her. Other people came to the vehicle and helped pull her out, she said.
She was taken to a hospital for treatment and is now recovering at home. She said she was in pain, especially in her back. No children were in the minivan at the time.
Who owns the tree has not been reported.
California requires a claim against a public agency to be presented within six months (Gov. Code § 911.2), far shorter than the two-year deadline for most injury lawsuits. A tree that falls in high wind does not automatically end a claim, because investigators and insurers ask who owned it, whether it was healthy, and whether anyone knew it was a hazard.
Against a public agency, a dangerous-condition claim generally requires proof that the condition existed, that the agency knew or should have known about it, that it had time to fix or warn, and that it did neither. Inspection logs, trimming requests, prior complaints, and photographs of the tree and trunk before the site is cleared often decide these cases.
We take the insurance calls, evidence requests, and paperwork off your plate while you recover. Our Southern California personal injury lawyers look into who owned and maintained the tree, deal with the insurers, and file any required government claim before its short deadline. We also gather the tree-care and inspection records that may show who knew about the hazard.
