Santa Barbara, CA (October 18, 2026) - A 3-year-old girl was severely injured when a car struck her in a crosswalk on State Street in Santa Barbara at about 10 a.m. on October 18, according to local reports. She was walking with her family across the crosswalk near McKenzie Park, and no one else was injured.

Santa Barbara police, fire, and paramedics responded. First responders treated the child and took her to Santa Barbara Cottage Hospital. Because of the severity of her injuries, she was airlifted to a specialized hospital in Los Angeles, where she remained severely injured the next day, reports said.

The driver stayed at the scene and was not cited or arrested, according to the Santa Barbara Police Department. Police said drugs or alcohol are not suspected as factors, and the department is investigating the collision.

This is a developing story. Details may change as the investigation continues.

Crosswalk Crashes and Child Pedestrian Claims in California

The National Highway Traffic Safety Administration reported 7,080 pedestrian deaths in traffic crashes nationwide in 2024. California law requires drivers to yield to pedestrians in a marked crosswalk (Vehicle Code § 21950), and a decision not to cite a driver does not settle fault in a civil claim. Fault is decided on the evidence, and California's pure comparative fault rule means any shared blame reduces a recovery but does not bar it.

  • First steps: Keep every record and bill from both hospitals, ask police for the report number, and photograph the crosswalk, signs, and any damaged clothing or belongings. Nearby stores, buses, and doorbells may hold footage that is overwritten quickly.
  • Who may be liable: The driver, in some cases the vehicle's owner, and, if the crosswalk, signals, signage, or lighting played a part, the public agency responsible for the street.
  • Deadlines: Most injury claims must be filed within two years (CCP 335.1), which makes it October 18, 2028. California's rules for minors can give a child's own claim more time, but parents should not rely on that without advice. If a public agency may share responsibility, a claim must be presented within six months (Gov. Code § 911.2), by April 18, 2027.
