Legal Rights of Shooting Victims and Families in California

When a shooting results in death or serious injury, surviving family members and injured victims may have civil legal options that exist entirely apart from the ongoing criminal investigation. In California, both wrongful death and civil rights injury claims can move forward independently of any criminal proceedings.

Depending on the circumstances and the evidence that emerges, potential areas of civil liability may include:

  • Claims against the shooter or shooters for assault, battery, and all resulting harm
  • Third-party liability if a property owner, business, or another party's negligence contributed to conditions that enabled the shooting
  • Wrongful death claims on behalf of families of those killed, under California Code of Civil Procedure § 377.60

What Families and Victims Should Know

A criminal investigation may take considerable time, and a civil case does not require a criminal conviction or arrest to proceed. In California, civil rights and wrongful death claims are generally subject to a two-year statute of limitations from the date of the incident (California Code of Civil Procedure § 335.1). Seeking legal guidance early can help preserve critical evidence and protect your rights within that window.

If you or your family has been affected by this incident, consider the following steps:

  • Document and preserve all medical records, expenses, and communications related to the incident
  • Gather and retain any available evidence, photographs, or witness contact information
  • Avoid providing recorded statements to any insurance representative before consulting with an attorney
  • Contact a wrongful death attorney promptly to understand your legal options under California law
