When a Road Hazard Plays a Part in a Crash in San Bernardino, CA

Claims against a city, county or other public entity for personal injury generally must be presented within six months under Government Code section 911.2, far sooner than the usual two years.

Investigators have not said why the truck left the road. Who owns and maintains the end of that road- whether a government agency, a private landowner, or a contractor- decides which rules apply. A claim over a hazard on public property generally requires proof of three things. The dangerous condition existed, the owner knew or should have known about it, and it was not fixed or marked in time. Evidence at a roadway end, such as skid marks, barricade placement, and lighting, can change quickly. Cleanup or moving the mound can erase it.

  • First steps: Get medical care, ask San Bernardino police for the report number, and photograph the mound, any barricades or signs, and the lighting before the site changes.
  • Who may be liable: The driver, if driver error is found, and whoever controls the land or work site where the mound sits, depending on what the evidence shows.
  • Deadlines: A claim against a public entity must be presented by April 17, 2027. The ordinary two-year filing deadline under Code of Civil Procedure section 335.1 is October 17, 2028. California's pure comparative fault rule lets a partly responsible person recover a reduced share.
