Civil Rights and Wrongful Death Claims in California

When someone dies in an encounter involving civilian violence or a delayed police response, surviving family members may have legal avenues to pursue accountability.

  • Wrongful death claims can target responsible third parties when evidence shows negligence or intentional conduct led to the death
  • If a business, property owner, or security provider failed to maintain reasonably safe conditions, that failure may also factor into liability
  • Families who depended on the deceased may recover damages for lost financial support, funeral and medical expenses, and loss of companionship
  • California gives surviving spouses, children, and parents two years from the date of death to file suit (CCP § 335.1)

If government agency conduct contributed to the circumstances, a separate claim may apply under the Government Claims Act, with notice required within six months (Govt. Code § 911.2).
