Your Rights After a Two-Car Freeway Crash in Los Angeles County

The CHP has not said how this crash happened, so the points below apply to anyone hurt in it.

  • Who may be liable: either driver, depending on what investigators find. If a driver was working at the time, the employer can share responsibility.
  • How fault is decided: the CHP report, photographs, vehicle damage patterns, witness accounts, and traffic camera video.
  • If fault is shared: California uses pure comparative fault, so a person can recover even when partly responsible. The award is reduced by that percentage.
  • Insurance that may apply: the at-fault driver's liability policy, your own uninsured and underinsured motorist coverage, and medical payments coverage if you carry it.
  • What a claim can cover: medical bills, lost income, and pain and suffering, including from an injury that seemed minor at first but lingers.
  • Deadline: California allows two years for an injury lawsuit, which puts the filing date at October 15, 2028.
  • Government notice: if a public agency or government vehicle turns out to be involved, a claim must be presented within six months. That date is April 15, 2027.
