Legal Rights of Shooting Victims in California

When multiple people are injured in a single shooting incident, each victim has individual legal rights that may be pursued independently of any criminal case. In California, shooting victims may have civil legal options entirely separate from the ongoing law enforcement investigation.

Depending on the facts that emerge, potential areas of civil liability may include:

  • Claims against the shooter for assault, battery, and all resulting harm
  • Premises liability if a property owner such as the owner of a nearby residential or commercial building failed to address known safety risks on or around the property
  • Claims for medical expenses, lost wages, pain and suffering, and other damages arising from each victim's specific injuries

What Shooting Victims and Their Families Should Know

A civil claim in California does not require a criminal conviction or even an arrest to move forward. Each of the three victims in this incident may have independent grounds to pursue compensation. Civil rights claims are generally subject to a two-year statute of limitations from the date of the injury (California Code of Civil Procedure § 335.1), making early legal consultation important.

If you or a loved one was injured in this shooting, consider the following steps:

  • Seek and document all medical treatment, including emergency care and follow-up visits
  • Preserve any available evidence, photographs, or witness contact information related to the incident
  • Avoid providing recorded statements to any insurance representative before consulting with an attorney
  • Contact a LA civil rights attorney as soon as possible to understand your rights and protect your legal options under California law
