What Families Should Know After a Fatal Shooting in California

Does the family have to wait for an arrest before pursuing a civil claim?

No. A civil wrongful death claim runs entirely independently of the criminal investigation. The family does not need a suspect identified, an arrest made, or a criminal charge filed to begin protecting their legal options. Even if the shooter is never criminally prosecuted, a civil claim can still proceed on a different evidentiary standard.

What can a civil wrongful death claim cover?

In California, wrongful death claims compensate surviving family members for the loss of financial support, the loss of household services, and the loss of the relationship itself — companionship, guidance, moral support. A separate survival action can recover for the deceased's own pain, suffering, and economic losses before death. Both are typically pursued together.

What is the filing deadline?

Under California law, both wrongful death and personal injury claims must generally be filed within two years of the underlying event (CCP § 377.60 and § 335.1). This shooting occurred on May 24, 2026 — the outside deadline is May 24, 2028. If any claim involves a public entity, a formal government tort claim must be filed within six months under the California Government Claims Act, which would place that deadline on or about November 24, 2026.

What should the family do now?

Document everything. Save voicemails, texts, hospital records, social media communications, and the names of every officer, hospital staff member, and witness anyone in the family has spoken with. Do not give recorded statements to insurers, do not sign documents from any insurance carrier or hospital business office, and do not discuss case theories on social media. Public posts can be subpoenaed.

"The hardest cases are the ones where a family is waiting on a name to be released, an arrest that may never come, and a criminal case that has nothing to do with what they actually need — which is answers, accountability, and a way to take care of the people their loved one left behind. Those questions don't wait for prosecutors. Neither does the evidence."
