Legal Rights of Shooting Victims in California

Sustaining gunshot injuries, even non-life-threatening ones, can result in significant medical expenses, lost income, and lasting physical and emotional harm. In California, shooting victims may have civil legal options entirely separate from any criminal investigation.

Depending on the circumstances that develop, potential areas of civil liability may include:

  • Claims against the shooter for assault, battery, and all resulting damages
  • Premises liability if a property owner failed to maintain safe conditions or address foreseeable risks at or near the location where the shooting occurred
  • Claims for medical expenses, lost wages, pain and suffering, and other damages arising from the injuries sustained

What Shooting Victims Should Know

A civil case can move forward in California independently of a criminal investigation. An arrest or conviction is not a prerequisite to pursuing compensation. Civil rights claims are generally subject to a two-year statute of limitations from the date of the injury (California Code of Civil Procedure § 335.1). Early legal consultation can help preserve evidence and protect your rights within that window.

If you were injured in a shooting, consider taking the following steps:

  • Seek and document all medical treatment, including emergency care and any follow-up visits
  • Preserve any available evidence, photographs, or witness contact information
  • Avoid providing recorded statements to any insurance representative before consulting with an attorney
  • Contact a civil rights attorney promptly to understand your rights under California law
