Legal Rights of Shooting Victims in California

Sustaining gunshot wounds can result in serious, long-term physical and financial consequences. In addition to any criminal investigation, shooting victims in California may have civil legal options independent of law enforcement proceedings.

Depending on the circumstances, potential areas of civil liability may include:

  • Claims against the shooter for assault, battery, and all resulting damages
  • Third-party liability if a property owner — such as a business — failed to maintain adequate security measures on their premises, contributing to conditions that allowed the attack to occur
  • Claims for medical expenses, lost income, pain and suffering, and other damages arising from the injuries

What You Should Know After a Shooting

A criminal investigation can take considerable time, and a civil claim does not require a criminal conviction to proceed. In California, civil rights claims are generally subject to a two-year statute of limitations from the date of injury (California Code of Civil Procedure § 335.1), making it important to seek legal guidance early.

If you or a loved one was injured in a shooting, consider these steps:

  • Seek and document all medical treatment, including follow-up care
  • Preserve any available evidence, photographs, or witness contact information
  • Avoid providing recorded statements to insurance representatives before consulting with an attorney
  • Speak with a Los Angeles civil rights lawyer to understand your rights under California law
