Key Legal Points After a Sheriff's Vehicle Crash in La Puente, CA

California law requires other drivers to yield to an emergency vehicle that is sounding a siren and showing a lit red lamp (Vehicle Code 21806). Reports so far do not say whether the deputy was using either at the time, and no one has assigned fault.

  • First steps: Anyone in the SUV or the deputy's vehicle should see a doctor even if pain is mild, since symptoms can appear days later. Request the crash report number and photograph the vehicles and the driveway.
  • Who may be liable: The SUV driver, the deputy, or both, and the County of Los Angeles if the deputy was acting in the course of duty.
  • If fault is shared: California applies pure comparative fault, so recovery is reduced by a person's share of blame and is not barred by it.
  • Insurance that may apply: The SUV driver's liability policy, uninsured and underinsured motorist coverage, and any coverage the county carries for its vehicles.
  • Property damage: The owner of the parked vehicle in the driveway may have a claim for repairs and loss of use.
  • Deadlines: The two-year filing deadline for an injury claim is November 1, 2028 (CCP 335.1). A government claim against the county is due within six months, by May 1, 2027 (Government Code 911.2).
